These Terms & Conditions (“Terms”) govern your access to and use of the NineX19 website, online store, products, content, and related services. The website is operated by NineX19 LLC (“NineX19,” “we,” “us,” or “our”).

By accessing this website, creating an account, submitting information, or placing an order, you agree to these Terms and to the policies incorporated into them by reference. If you do not agree, do not use the website or place an order.

1. ELIGIBILITY AND LEGAL COMPLIANCE

You may purchase products from NineX19 only if you are legally permitted to possess, purchase, receive, and use them under all applicable federal, state, and local laws.

By placing an order, you represent that:

You are of the legal age required to purchase and receive the products ordered.
You are not prohibited from possessing or receiving the products ordered.
Your purchase is for a lawful purpose.
You are not purchasing on behalf of a prohibited person.
The billing, shipping, identity, and other information you provide is truthful, accurate, and complete.
You will not export, transfer, resell, or otherwise distribute any product in violation of applicable law.

The availability of a product on our website does not mean that the product may legally be purchased, possessed, installed, or used in every jurisdiction. You are responsible for understanding the laws applicable to you and your location.

2. PRODUCT RESTRICTIONS

Some products sold by NineX19 may be restricted based on the product, purchaser, shipping destination, or intended use. Restrictions may include age verification, identity verification, delivery-signature requirements, shipment to a licensed firearms dealer, or a complete prohibition on sale or delivery.

We may request identification, proof of age, proof of address, dealer information, or other documentation before processing or shipping an order. Failure to provide requested information within a reasonable period may result in delay or cancellation.

NineX19 may refuse, hold, or cancel any order that we believe:

Violates federal, state, or local law.
Contains inaccurate or inconsistent purchaser information.
Is intended for an unauthorized recipient or prohibited destination.
Presents a suspected fraud, diversion, export, or compliance risk.
Cannot be completed using a legally compliant shipping method.

Our decision to accept a previous order does not obligate us to accept a future order.

3. CALIFORNIA ORDERS

Orders shipped to California may be subject to additional product restrictions, purchaser verification, address-matching requirements, signature requirements, or delivery through an appropriately licensed California firearms dealer.

The requirements applicable to California orders are explained in our California Identity Verification & Privacy Policy, which is incorporated into these Terms by reference.

California orders may remain on hold while required information is reviewed. Placing an order does not guarantee that the order can legally be shipped directly to the purchaser or completed at all.

4. UNITED STATES SALES ONLY

NineX19 does not ship products outside the United States. You may not use a freight forwarder, export service, intermediary, or false domestic address to obtain products for export.

You are responsible for complying with all applicable export-control laws and regulations. Any order suspected of being connected to an unauthorized export may be held, refused, or canceled.

5. ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase the products listed in the order. An automated order confirmation acknowledges receipt of that offer but does not constitute acceptance.

We may review an order for product availability, payment authorization, fraud risk, legal restrictions, purchaser eligibility, and shipping requirements before accepting it. An order is accepted when we approve it for fulfillment or ship it.

We reserve the right to:

Accept or decline any order.
Limit purchase quantities.
Correct pricing or product-information errors.
Request additional information.
Place an order on hold.
Cancel an order that cannot be lawfully or accurately fulfilled.

If we cancel an order after payment has been captured, we will issue any refund due to the original payment method.

6. PRICES, PAYMENT, AND TAXES

Prices and product availability may change without notice. The price shown when an order is submitted is subject to correction if the website contains an obvious pricing, calculation, or listing error.

You authorize NineX19 and its payment-service providers to authorize and charge the payment method submitted with your order. Some orders may be authorized when placed and captured only after compliance review or approval for fulfillment.

You are responsible for applicable sales tax, shipping charges, transaction fees, and other charges disclosed during checkout.

You may not initiate an improper chargeback or payment dispute to avoid a valid payment obligation. Contact Customer Support first if you believe a charge is incorrect or an order has not been handled properly.

7. ACCURATE CUSTOMER INFORMATION

You agree to provide current, complete, and accurate contact, billing, shipping, and account information.

NineX19 is not responsible for delays, failed delivery, additional carrier charges, or lost shipments caused by an incomplete or incorrect address supplied by the customer. Address changes are not guaranteed after an order has entered processing.

For orders requiring identity verification, the shipping address may be required to match the address shown on the purchaser’s identification. Orders requiring delivery through a licensed dealer must be shipped to the approved dealer address.

8. SHIPPING AND DELIVERY

Order-processing times and carrier transit estimates are estimates, not guaranteed delivery dates. Delays may occur because of order volume, product assembly, compliance review, weather, carrier operations, holidays, or other circumstances outside our control.

Some orders require an adult signature or another restricted delivery service. The customer is responsible for ensuring that an eligible recipient is available to receive the shipment.

Our complete shipping, delivery, return, and exchange rules are stated in our Shipping & Returns Policy, which is incorporated into these Terms by reference.

9. RETURNS, EXCHANGES, AND CANCELLATIONS

Returns and exchanges are accepted only as described in our Shipping & Returns Policy.

Do not return a product without first contacting Customer Support and receiving return instructions. Unauthorized returns may be delayed, refused, or returned to the sender.

Products that have been installed, fitted, modified, fired, damaged, or removed from their original condition may be ineligible for return except when applicable warranty coverage or law provides otherwise.

An order-cancellation request is not effective until confirmed by NineX19. We cannot guarantee cancellation after an order has entered processing, assembly, packaging, or shipment.

10. PRODUCT INFORMATION AND APPEARANCE

We work to provide accurate descriptions, specifications, compatibility information, photographs, prices, and availability. However, website content may occasionally contain errors or become outdated.

Product colors and finishes may appear differently depending on lighting, photography, screen settings, coating batches, materials, and normal manufacturing variation. Minor cosmetic differences that do not affect function are not necessarily defects.

We may correct errors, update information, change specifications, or cancel an affected order. When a material error affects an unshipped order, we may contact the customer before proceeding.

11. COMPATIBILITY AND FITMENT

The customer is responsible for confirming that a product is compatible with the exact firearm model, generation, configuration, optic, ammunition, and other components with which it will be used.

References to a firearm model or generation describe intended compatibility and do not guarantee compatibility with modified firearms, aftermarket components, unusual tolerances, or combinations not identified in the product description.

Contact Customer Support before ordering if you are uncertain about fitment. Installation or use contrary to the product description, instructions, or intended application may cause damage or unsafe operation.

12. INSTALLATION, MODIFICATION, AND SAFE USE

Firearm components must be installed, inspected, maintained, and used correctly. Professional installation by a qualified gunsmith is recommended whenever fitting, adjustment, diagnosis, or technical knowledge is required.

Before installing, inspecting, cleaning, or handling any component, confirm that the firearm is unloaded and follow the firearm manufacturer’s safety procedures.

You are responsible for:

Proper installation and fitment.
Inspection before use.
Using appropriate ammunition and compatible components.
Following all manufacturer instructions and safety practices.
Discontinuing use if a product appears damaged, improperly fitted, or unsafe.

NineX19 is not responsible for damage caused by improper installation, unauthorized alteration, misuse, abuse, neglect, improper maintenance, incompatible parts, improper ammunition, or failure to follow instructions. These limitations do not exclude responsibility that cannot lawfully be limited.

13. WARRANTY

Products manufactured by NineX19 are covered only as stated in the applicable Warranty Info page or product-specific written warranty.

Products manufactured by third parties may be covered by the original manufacturer’s warranty. Unless expressly stated otherwise, NineX19 does not expand or replace a third-party manufacturer’s warranty.

Warranty coverage does not automatically include problems caused by improper installation, modification, abuse, neglect, incompatible components, ordinary wear, cosmetic variation, corrosion caused by improper care, or use outside the product’s intended application.

Nothing in these Terms limits any warranty right or consumer protection that cannot legally be waived.

14. WEBSITE ACCOUNTS

You are responsible for protecting your account credentials and for activity conducted through your account. Notify us promptly if you suspect unauthorized access.

We may suspend or terminate an account associated with fraud, abuse, unlawful activity, security threats, repeated payment disputes, false information, or violations of these Terms.

15. PROHIBITED WEBSITE USE

You may not use the website to:

Violate any law or regulation.
Submit false, misleading, or fraudulent information.
Impersonate another person.
Interfere with website security or operation.
Introduce malicious software or code.
Scrape, harvest, or collect information without authorization.
Attempt unauthorized access to any account, system, or data.
Infringe the intellectual-property or privacy rights of NineX19 or another party.
Facilitate an unlawful purchase, transfer, possession, or export.

We may restrict access to the website or cancel associated orders when prohibited activity is suspected.

16. INTELLECTUAL PROPERTY

The NineX19 name, logos, product names, original product designs, photographs, graphics, text, and other website content are owned by or licensed to NineX19 and are protected by applicable intellectual-property laws.

You may not reproduce, modify, publish, distribute, sell, or commercially exploit our website content without written permission.

Product names and trademarks belonging to other companies are used only to identify compatibility, describe products, or identify third-party goods. Their use does not imply sponsorship, affiliation, approval, or endorsement.

17. THIRD-PARTY SERVICES AND LINKS

The website may use or link to third-party services, including payment processors, shipping carriers, analytics services, embedded media, social platforms, and other websites.

NineX19 does not control third-party websites or services and is not responsible for their content, availability, security, or independent practices. Your use of a third-party service may be governed by that party’s own terms and privacy policy.

18. PRIVACY

Our collection, use, retention, and disclosure of personal information are governed by our Privacy Policy.

Information collected specifically for California purchaser verification is also governed by our California Identity Verification & Privacy Policy.

19. DISCLAIMER OF WEBSITE WARRANTIES

The website and its general informational content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, current, or free from errors.

This website disclaimer does not replace, reduce, or eliminate any express written warranty that applies to a product.

To the fullest extent permitted by law, NineX19 disclaims warranties relating solely to the operation of the website or general informational content that are not expressly stated in these Terms.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by law, NineX19 and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website or a transaction with NineX19.

This limitation does not apply to liability that cannot legally be excluded or limited. It also does not alter the remedies expressly provided by an applicable written product warranty.

21. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless NineX19 and its owners, officers, employees, and agents from third-party claims, damages, liabilities, and reasonable expenses resulting from your unlawful conduct, material violation of these Terms, unauthorized export or transfer, or infringement of another party’s rights.

This provision does not require a consumer to indemnify NineX19 for NineX19’s own unlawful conduct, negligence, or breach of its obligations.

22. ELECTRONIC COMMUNICATIONS

You consent to receive transaction-related communications electronically, including order confirmations, verification requests, shipping notices, policy notices, and Customer Support responses.

You are responsible for providing an email address and telephone number at which you can receive communications concerning your order. Transactional communications are separate from optional marketing communications.

23. CHANGES TO THESE TERMS

We may update these Terms when our website, products, practices, or legal obligations change. The current version will be posted on this page with its effective date.

Changes apply prospectively from the stated effective date. Changes will not retroactively alter the material terms governing an order already accepted unless required by law or agreed to by the customer.

24. GOVERNING LAW AND VENUE

These Terms and any dispute arising from them are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

To the extent permitted by law, any legal proceeding arising from these Terms or a transaction with NineX19 must be brought in a state or federal court having jurisdiction in Bucks County, Pennsylvania.

This section does not prevent a consumer from exercising rights that cannot lawfully be waived under the laws applicable to that consumer.

25. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

26. NO WAIVER

Our failure to enforce a provision of these Terms does not waive our right to enforce it later. A waiver is effective only when made in writing by NineX19.

27. ENTIRE AGREEMENT

These Terms, together with the policies and product-specific terms incorporated by reference, constitute the agreement between you and NineX19 concerning your use of the website and purchases through it.

If a product-specific written warranty or disclosed product term conflicts with these general Terms, the product-specific provision controls only for the subject it expressly addresses.
